Montana Residency Requirements For Divorce
Either spouse must have been a resident of Montana for ninety days before filing.

Montana recognizes two no-fault divorce grounds:
- serious marital discord and no reasonable prospect of reconciliation (irreconcilable differences)
- living separate and apart for 180 days prior to filing

Child support will continue until the child reaches the age of majority, or completes high school, but may be extended by agreement of the parties or court order under some circumstances.

Proceeding for divorce in Montana shall occur in the county where petitioner has resided during the 90 days preceding the action.
