Texas Residency Requirements For Divorce

One spouse must have lived in Texas for at least six months prior to a divorce being initiated. Additionally, the filing party must have been a resident of his or her county for at least ninety days prior to the filing.

Texas court policy prefers that divorcing parties continue to co-parent their children as joint managing conservators. Joint managing conservatorship does not necessarily require that the children share their time equally between their parents. If it can be shown that joint managing conservatorship is not in the children's best interest, either parent may be awarded sole managing conservatorship with the other being awarded visitation rights. Generally, the courts prefer that the parents reach their own decisions pertaining to the Custody of their children. Any agreement between the parties which is not clearly contrary to the children's best interest will generally be approved by the court.
